You May be Able to Challenge your Breathalyzer Test Results
You may have heard that a breath test with a BAC reading of .08 or greater means an automatic conviction. In a sense, this is true. This is true only if the test result is reliable and admissible. However, a reading of .08 shall only create a presumption that a person's ability to drive was sufficiently impaired. This presumption can be rebutted with reliable evidence presented at trial.
