You May be Able to Challenge your Breathalyzer Test Results
You may have heard that a breath test with a BAC reading of .08 or greater means an automatic conviction. In a sense, this is true. This is true only if the test result is reliable and admissible. However, a reading of .08 shall only create a presumption that a person's ability to drive was sufficiently impaired. This presumption can be rebutted with reliable evidence presented at trial.
The "if" is significant. There are a variety of reasons breathalyzer test results might be subject to challenge. The machine itself might be unreliable or might not have been properly maintained. The test may not have been conducted properly, or the evidence may not have been preserved as the law requires.
